1. Acceptance of Terms

By accessing or using Djaty (“the Platform,” “we,” “our,” or “us”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to all of these Terms, do not use the Platform. These Terms apply to all visitors, users, and others who access or use Djaty.

2. Description of Service

Djaty provides an all-in-one platform that enables digital creators to build storefronts, upload and sell digital products (files, e-books, templates, audio, software, and any downloadable content), and receive payments from customers globally. We charge a commission on each completed sale.

3. Account Registration

• You must be at least 16 years old to create an account.
• You must provide accurate, current, and complete information during registration and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Notify us immediately at support@djaty.com if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use Djaty to:

• Sell illegal content, counterfeit goods, or products that infringe on third-party intellectual property rights.
• Distribute malware, viruses, or any harmful code.
• Engage in deceptive practices, fraud, or mislead customers about your products.
• Violate any applicable local, national, or international law or regulation.
• Harass, abuse, or harm other users, buyers, or Djaty employees.
• Attempt to gain unauthorized access to the Platform or its underlying systems.
• Use automated tools to scrape or extract data from the Platform without permission.

5. Intellectual Property

5.1 Your Content

You retain full ownership of all digital products and content you upload to Djaty. By uploading content, you grant Djaty a limited, non-exclusive, royalty-free license to host, store, and deliver your content to buyers as part of providing the service.

5.2 Djaty's Content

All intellectual property related to the Djaty platform, including trademarks, software, design, and content created by Djaty, is owned by Djaty. You may not copy, modify, distribute, or create derivative works without our written permission.

6. Fees and Payments

• Djaty is free to use. We charge a per-sale commission on each completed transaction. Current rates are published on our Pricing page.
• Commission rates are subject to change. We will provide reasonable notice to sellers before any changes take effect.
• Payments are processed through third-party providers (e.g., Polar). You are subject to their terms of service.
• Djaty is not responsible for failed payments, chargebacks, or disputes initiated by your customers.

7. Refunds and Disputes

Please refer to our Refund Policy for complete details. As a seller, you agree to honor any refund obligations imposed by applicable consumer protection laws in your customers' jurisdictions.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine you have violated these Terms or applicable law. You may close your account at any time by contacting support. Upon termination, your right to access the Platform ceases immediately, and we may delete your stored data in accordance with our retention policy.

9. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DJATY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DJATY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE COMMISSIONS PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Djaty and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to These Terms

We may revise these Terms at any time. We will provide at least 30 days' notice before changes take effect by posting the revised Terms on this page. Your continued use of Djaty after the effective date constitutes acceptance of the new Terms.
